No — Shopify does not collect and remit sales tax for you on orders placed through your own Shopify storefront. As of 2026-07-21 the only Shopify channel that collects and remits on your behalf is the Shop app. On storefront orders Shopify can calculate and charge tax at checkout, but you remain the seller of record: you register with each state, you file the returns, and you send the money. Shopify's own documentation is explicit — Shopify doesn't remit or file your taxes for you, unless you use Shopify Tax and set up automated filing
.
Why Shopify is not a marketplace facilitator
Marketplace facilitator laws (New York calls them marketplace providers) shift the collection duty from the seller to the platform. The statutory test has two prongs, and a platform has to meet both. Using New York's wording: a marketplace provider is a person who provides a forum for third parties to make a sale or accept an offer of sale
and collects the receipts paid by a customer to a marketplace seller
. New York states the negative directly: A person that provides a forum for third parties to make sales or the offer of a sale is not a marketplace provider if it (or an affiliate) does not collect the payment paid by a customer.
A Shopify store fails both prongs. It is not a third-party forum — it is your storefront on your own domain, and the buyer is transacting with you, not with a marketplace of competing sellers. And Shopify Payments processes the card on your behalf into your account; it does not collect the receipts as a principal the way Amazon or Etsy do. That is the whole difference. Shopify sells you store software and payment processing; Amazon and Etsy sell your product on their own marketplace.
The practical consequence: everything a marketplace facilitator would have absorbed for you stays yours. If you cross a state's economic nexus threshold on Shopify sales, you register in that state yourself. Compare this with Amazon FBA or Etsy, where the platform is the facilitator and remits for you.
The one exception: the Shop app
Orders placed inside the Shop channel — Shopify's own consumer shopping app — are a genuine marketplace, and Shopify treats them that way. Per Shopify's Help Center, as of January 1, 2025 the Shop channel automatically collects, remits, and files taxes for all orders shipping to or within the United States
, with tax reported under SC Commerce Services Inc.
Shopify's US tax reference adds that the channel does this independently of your nexus status and store tax settings
— Shop-channel tax can be collected in states where you have no nexus and no registration at all.
This is the detail that trips up sellers reconciling payouts: Shop orders and storefront orders sit in the same Shopify admin but have two different tax owners. Do not remit Shop-channel tax again on your own return — it has already been remitted by Shopify. Shopify still cautions that you might still need to include these transactions in your reporting to your local or state authority
, because several states want facilitated sales disclosed as a deduction rather than omitted.
Three Shopify tax jobs that are still yours
- Deciding where you have nexus. Shopify will happily charge tax in a state you enable, but enabling a state is not registering in it — and charging tax without a permit is itself a violation in most states. Determine nexus first with the nexus calculator, then register, then switch collection on.
- Registering and filing. Shopify does not register with any Department of Revenue on your behalf. Shopify Tax offers an optional automated filing add-on in a limited set of states; outside that, the return is yours to file on the state's cadence.
- Getting local rates right. Destination-sourcing states with home-rule or self-administered local jurisdictions (Colorado, Louisiana, Alabama, Alaska) are where a basic rate table drifts from what the jurisdiction actually charges. Check your highest-volume states individually.
Frequently asked
Does Shopify collect sales tax automatically? It calculates and charges tax on storefront orders once you enable a state, and it collects, remits, and files on Shop app orders. It does not remit or file storefront tax unless you enable Shopify Tax automated filing.
Is Shopify a marketplace facilitator? Not for your own storefront — you are the seller of record. Shopify does act as the collecting party for Shop app orders as of January 1, 2025.
Do my Shopify sales count toward a state's economic nexus threshold? Yes. Storefront sales are your own direct sales and count in every state. Whether facilitated Shop-channel sales also count depends on the state — most states exclude marketplace-facilitated sales from the seller's own threshold, but not all. Check the state: California, Texas, Florida, or all 50 states.
